Recently, three administrative litigation cases involving the revocation and review of core trademarks of a certain technology company represented by Zhilin Law Firm have received judgments. The Beijing Intellectual Property Court fully accepted the lawsuit request of lawyer Zhilin Yanjin, and the core trademark of the client facing the risk of invalidation was successfully maintained.

This case stems from an application for revocation filed by others against three core trademarks owned by the client, citing "cessation of use for three consecutive years". At the hearing stage of the China National Intellectual Property Administration, the customer once entrusted other agencies to defend, but the result was not satisfactory, and some core services were cancelled. After receiving the unfavorable ruling, the client entrusted Lawyer Yan Jin to file a lawsuit with the Beijing Intellectual Property Court.
This case faces three challenges: firstly, the service projects designated by the trademark in question, such as "sales promotion for others, commercial management assistance, financial analysis, and guarantee", are already difficult to prove and have high recognition standards in judicial practice; Secondly, the customer adopts a new service model that relies on big data technology innovation, and its service process and delivery methods have a high threshold for external understanding; Thirdly, and most importantly, the case lacks key evidence such as invoices that can directly prove the performance of the contract. How to reconstruct the fact of trademark use without direct evidence has become the biggest challenge.
To overcome the difficulties, Lawyer Yan Jin has carried out systematic work: nearly 20 rounds of in-depth communication with the client's intellectual property legal department, more than ten exchanges of supplementary materials, and in-depth sorting of business logic; During the litigation phase, more than 50 sets of new evidence with a capacity of nearly 2G were carefully organized and submitted for three cases, and a complete evidence chain was constructed; Within the limited trial time, accurately grasp the key points and explain the complex big data service model to the judge in a simple and understandable manner; Submit a 40 page proxy statement in a timely manner after the trial, further systematically elaborate on legal viewpoints, and maintain active and effective communication with the judge team.
Through the above professional and meticulous efforts, Lawyer Yan Jin successfully overcame the difficulties of the case and ultimately won the full support of the court, achieving a satisfactory result far beyond the client's expectations. This victory not only maintains the core trademark assets of the client, but also demonstrates the professional ability of Zhilin's intellectual property team in handling trademark disputes related to new business models, reflecting its professional value in safeguarding innovative achievements for clients in fierce market competition.
