Recently, Lawyer Xu Hao, a partner of Zhilin Law Firm, successfully represented the "Beijing High Value Real Estate Transfer Dispute Case" and was awarded the "Excellent Level" case by the legal research institution LegalOne. This case has been highly recognized by the jury due to its involvement of high assets and innovative judicial practices, and has important reference value for the handling of similar complex property disputes.

The case can be traced back to 2002, when Ms. Sun signed a house transfer agreement with Mr. Yu, agreeing to sell her affordable housing in Beijing for 260000 yuan. After Mr. Yu pays the down payment, he promises to bear the subsequent mortgage loan and related expenses. However, due to the fact that their family already owns multiple properties under their name, which does not comply with Beijing's housing purchase restriction policy, the transfer of ownership of the property has never been completed. In 2019, Mr. Yu sued Ms. Sun for cooperation in handling property transfer registration; Ms. Sun filed a counterclaim, requesting to terminate the contract and reclaim the house.


Lawyer Xu Hao represented Ms. Sun in this case and formulated litigation strategies around the core demands of "terminating the contract and returning the property". The focus of the case dispute is on three aspects:


Responsibility determination under the purchase restriction policy: Lawyer Xu Hao pointed out that the inability to perform the contract was due to policy restrictions, and Ms. Sun did not breach the contract, so she should not be held liable for breach of contract.


Reasonable distribution of property appreciation income: The value of the property has increased from 260000 yuan to over 7 million yuan, and Mr. Yu advocates that he should receive a total appreciation income of over 7 million yuan. Lawyer Xu Hao successfully pushed the court to adopt a fair distribution plan that takes into account both the principle of fairness and proportion by providing evidence that Mr. Yu has been occupying the house for a long time and obtaining rent.


Innovation and Fairness in Judicial Practice: The judgment of this case clearly states that "the distribution of value-added income should be based on the principle of fairness, not just the proportion of capital contribution", which sets an important reference for the trial of similar cases.


The second instance court ultimately adopted the opinion of lawyer Xu Hao and revised the judgment to require Ms. Sun to pay value-added compensation to Mr. Yu according to the amount requested by lawyer Xu Hao's appeal, successfully reducing the economic burden of the parties by more than 2 million yuan and achieving a reasonable balance of interests for both parties after the termination of the contract.
